LiveOffice,
the number-one global provider of cloud-based email
archiving, email
compliance, email
discovery and email
continuity solutions, today introduced two new features for its LiveOffice
Discovery Archive solution, Collaborative Discovery and Retention
Tags. Designed to streamline the discovery process for larger
organizations that are beginning to adopt cloud-based archiving,
Collaborative Discovery supports cross-functional collaboration on
matters, so internal and external legal teams, IT, HR and other
stakeholders can work more efficiently together. Retention Tags give
organizations much more granular control over their archives, allowing
them to easily enforce legal
holds, manage retention policies and customize retention periods to
meet specific needs.
According to a Litigation Cost Survey of Major Companies, prepared for
the 2010 Conference on Civil Litigation at Duke Law School, the ratio of
pages discovered to pages entered as exhibits is as high as 1,000:1. The
study also found that the cost of discovery in enterprises can range
from $600,000 to nearly $10,000,000 with one of the most significant
variables being the review and production of ESI.
“The amount of ESI continues to increase, which will only make the
variable component of discovery become higher and more unpredictable,”
said Brian Babineau, vice president of research and analyst services for
Enterprise Strategy Group (ESG). “It is time for organizations to treat
e-discovery as a business process and focus on all tasks, from managing
information more precisely to evidence production. Starting with a
flexible archiving solution that facilitates retention, preservation and
proper disposition of distributed content can go a long way in
simplifying the e-discovery process.”
Archiving spans much more than highly regulated industries today, and
some companies don’t want to be forced to keep data indefinitely if they
don’t have a legal obligation to do so. However, they still want to have
clear and organized retention policies and the ability to enforce legal
holds. Many companies also need to rely on users to classify content. Retention
Tags allow organizations to:
-
Define retention policies with different retention periods,
depending on the type of content, specific users, folders or other
custom criteria
-
Use tags to delineate system- and user-driven retention periods
-
Enforce legal holds (and apply them in 30 seconds or less – see www.legalholdchallenge.com
for more details)
Seamless delegation and collaborative reviewing are essential components
of e-discovery for enterprises. Approved matter owners can delegate to
and/or share access with multiple reviewers for a single matter or even
on a per search basis. It is also important to have efficient internal
reviews of matters to reduce exorbitant production costs. Collaborative
Discovery allows organizations to:
-
Delegate management of all matters to legal personnel
-
Divide email review tasks among multiple reviewers and assign
them different review action privileges
-
Use tags to categorize emails for more efficient review
-
Perform detailed exports of emails within a matter
-
Prove chain of custody from matter to reviewer to message
