Motorola reportedly secures injunction against Apple in Germany

Summary: Here’s a twist: Motorola Mobility has secured an injunction
against Apple selling mobile products in Germany.

The tables have (allegedly) turned. Motorola Mobility has secured an
injunction against the sale of Apple mobile products in Germany, according
to FOSS Patents’ Florian Mueller.

Citing “a copy of what purports to be a default judgment by the Mannheim
Regional Court,” this would mean that Apple is prohibited from selling any
mobile devices that infringe upon on two Motorola patents in Germany.

Additionally, Apple would owe MMI financial damages for patent
infringement stemming back from at least April 19, 2003. Wow.

Week-end or not, the legal war in the wireless industry continues. Apple
has just lost a patent infringement lawsuit filed by Motorola in Germany,
based on two patents described as “method for performing a countdown
function during a mobile-originated transfer for a packet radio system”
and “multiple pager status synchronization system and method”. Both are
fundamental enough that they could affect every single Apple
handset.According to German law, the court’s decision can lead to an
immediate stop in Apple sales to retailers in Germany, although it seems
that retailers can technically source Apple products from nearby
countries. The stop would take effect even if Apple plans to present
counter-arguments down the road.

At this point, nothing is set in stone, but keep in mind that Germany is
the biggest market in Europe, and that any trouble there can result in
serious financial losses for Apple. These lawsuits are fought with patents
as ammunition, and although Apple is now a heavy weight, old school
companies like Motorola may simply have more Firepower. Now you see why
Google has acquired Motorola Mobility.

Motorola patent firepower. That's what the Apple logo cultists pooh poohed
me about when I mentioned it earlier. You take on Motorola, you're taking
on the company that invented cell phones. Good luck with that in a patent
war.

It appears that Motorola has the authority to immediately stop Apple's
normal supply chain in Germany for mobile devices -- if they want to do
that. I've got a feeling they're going to talk to Apple first and try to
end this stupidity. Maybe with Jobs gone, Cook will come to his senses.
